Photography by Rachall - Terms and Conditions

IMPORTANT COVID-19 VIRUS 
As you might be aware that this virus has now gotten everyone including businesses on edge. In saying this my studio has always practised the same precautions when it comes to working with clients that come into the studio and their children & particularly newborns.
Myself and anyone I have in the studio at the time of your session is always updated with vaccines such as the whooping couch etc. We always wash, sanitize props, wraps and anything we use. The studio is always maintained to stay clean and during a session, we always use sanitizer when working.
During this uncertain time, we will continue to follow the guidelines of the government and at the moment will be continuing sessions in the studio.
Therefore we ask that you always apply by the information given that if you or anyone you have been in contact with who has been showing symptoms or has the virus to immediately cancel your session until further notice. Also if you feel slightly unwell, have a cold, cough, or just not yourself to not attend your booked session. Even if you aren't certain we prefer you cancel your session for the time being even if it's up to an hour of your booking.
If after your session you or anyone that's with you feel ill, we won't take any responsibility with it. Due to the nature of this virus wherein, it's been said that people don't know they have it or feel sick until 5-10 days.  
Everything said above will also apply to me (Rachall) the photographer and anyone from my staff on the day. We will cancel any booking if we to feel unwell or we feel unwell after the session.  We won't take you or anyone with you during the session responsible if Rachall or anyone from her staff feels unwell after your session. 
If we feel after you come into your session that you may be unwell we will ask you to leave with no hard feelings.
This is for the safety and well being of everyone. 

SOCIAL DISTANCING RESTRICTIONS FOR STUDIO SESSIONS
1. Please wash your hands before leaving your home.
2. Please do not attend your session if anyone of you is feeling unwell even the slightest. 
3. We will ask you to sanitize your hand before you enter the studio, during and before leaving the studio
4. If you're looking to have a family shot we can take a couple of shots towards the end of the session. 
5. The session will take 30-90 mins. The studio will be set up to allow easy social distancing measures. We ask you to attend to them.
6. Based on your questionnaire in regards to colours, Rachall will set up to shoot.
7. Rachall will be using also composite images to add to your gallery for you to choose from. These are already style set up images created which then we photograph the baby and add baby onto the images in photoshop. Based on the colours Rachall will show you what colour pallets are available.
8. No viewing and selection will be done on the day as we usually do. We will select the best images taken, upload them to an online gallery not edited for you to select, then send you the balance invoice to pay and then we will have them edited.
9. Payments must be paid when you have selected the images you'd like edited.
10. You have 3 days to select the images or further $50 fee will be applied, as per contract. 
11. Final Images will be loaded again online for you to view/mark so we can email you download link.
12. USBs are currently out of stock due to business closure, therefore, images can be only downloaded.
13. If your package includes USB it won't be provided at the moment, we will notify you once we have USB available. Surely we will have it as a download link in high resolution. 
Also to make the session run as quickly and smoothly we ask you to do the following:

• Feed your baby before the session

• Make sure the diaper is clean

• Have a pacifier/dummy even if your baby doesn’t use one

• Bring is extra milk if not breastfeeding

• Keep your belongings in your bag do not spread them out in the studio

• Stay seated to one end of the studio at all times

** If you were pulled over on the way to the studio please tell them you're just getting some essentials to prevent further questions. 

GENERAL INFORMATION:
1. Please note that it is important you are aware, looked out and understand how the booking procedure happens in our studio. Your deposit is to secure your session with us, which then later is deducted from your chosen packages
2. Packages are clearly set out and there are no hidden costs to you
3. Rachall has a certain style and way she photographs babies so it is important as the client you understand that by hiring Rachall you will be getting similar to her previous work
4. Any special requests such as to re-create an image you like, or if you have seen something you like to please email us and discuss it before your session.

5. • NOTE: NO ACCESS TO TOILET AND BATHROOM FACILITY! 
Unfortunately, there is no access to a toilet or bathroom due to the studio being in a converted garage and public liability insurance does not cover clients within the home. As it's inside its not deemed safe for both parties. Therefore you would need to make sure you are aware of this and prepare to go beforehand. There is a local shopping strip near Melton south station, Melton square that has toilets up the road. We apologize for any inconvenience.

IMAGE CONSENT:
1. In a digital age where businesses like ours depend on social media for booking other clients, we aim to share images, videos of the session online on social media and website. 
We understand some clients prefer not to, and as we respect people's privacy it's important to note that all newborns look similar and will not be identifiable. We do not mention the names of clients, or children in any of the images. 
If you allow me to use images for social media posts, please TYPE IN THE BOX: ‘Yes’ or ‘ No’
If you allow me to use the images, but yourself or other people photographed in this session prefer for me not to share images they are in please mention them in the comment box below

PHOTOGRAPHY STUDIO POLICIES & CONDITIONS:
1. It is understood that ‘Photography by Rachall’ is the official exclusive photographer retained to perform the photographic services requested on this contract
2. The photographer has the right to use these images under this contract for advertising, display, publication or other purposes of the persons in these photographed unless they tick the ‘Disagree’ in the above box of this contract in the 'General Information & Consent' section
3. All images created by ‘Photography by Rachall’ that includes digital images, negatives, prints, products and previews remain the exclusive property of ‘Photography by Rachall’
4. At the time when signing this contract the reserved day and time of your session is non-refundable, reschedule your session is acceptable only once only if there is availability.
5. If you do not show up to your session, reschedule less than 24 hours before your session due to any excuse or arrive more than 30 mins late an additional $100 fee will be applied to your final invoice. If you are late, the amount of time you are late will be taken from your session as the photographer needs to start, finish at that specific time and in some cases may have other clients booked on the same day.
6. In the event of the photographer being sick, unwell photographer has the option to reschedule session up to 2 hours before the session. Usually being fit for the session is best as a photographer avoids being sick around any newborn/ clients
7. If studio/photographer cannot go ahead with the session due to weather, an act of God, strike or anything out of control or emergency photographer may have, the photographer is entitled to reschedule your session. No refund will be given.
8. During your session Photographer (in regards to newborn sessions) will photograph newborn, siblings, parents. Newborns include 2-3 setups not more or less.
9. If the newborn is unsettled, does not seem well, Photographer has the permission to dismiss the session and refuse to continue to avoid having the newborn/child become sick or not feeling well.
10. If your child has had a rough start to life like at birth, has a medical condition and/ or has a disability or special needs its is extremely important you bring it to our attention before booking or in the event, this occurs after your booking you let us know. In some cases where newborn/child isn't fit or well to be photographed, we will not proceed. But it is your responsibility to let know. If you think your newborn/child is ok to come in for their session and they have been unwell, sick or anything of this kind then the Photographer holds no responsibility if anything may occur during or after your session. It's your duty as the parent to take this decision to bring your child in or not.
11. The photographer is not responsible for any newborn/ children/persons during the session left unattended and it is the client's responsibility to take care of the children during the session to avoid tripping over or hurting themselves as during the session it may get messy with props and items left on the studio floor
12. During your session Rachall usually, setups before you arrive so session starts right away, as she photographs you will see the setups, colours and might see back of the camera. When you view your images on the computer Rachall cannot go back to shoot another take or set up. This will be considered a second session and you may be charged accordingly
13. At the time of your session, you will view and select your images and purchase your digital package and pay your balance by the end of that day if by bank deposit. If for reasons photographer sees suitable any online galleries created will only be valid online to view/select your images for 2 days only or an additional $50 daily fee applies
14. NO alteration will be made of this contract if this occurs both parties will need to sign near changes.
15. Please do not bring any professional cameras to the studio
16. Please do not bring extended family or more than two adults unless it's been discussed with the photographer or studio team prior.
17. We do not tolerate any misbehaviour, bad language or abuse from clients and if any such things occur we do take matters seriously by calling the police or asking you to leave the premises
18. If you have or are having a boy, please DO NOT CIRCUMCISE your child before your session. We will be swaddling your baby tightly while he is naked, and moving him from one position to another constantly during the session. This is very painful for a child who has just been circumcised. We will NOT photograph a newborn who has been circumcised less than 6 days before the session.
19. In any dispute in the event, you or your family become injured during the session or while in the studio Photography by Rachall is not held responsible or liable for injury to you or your family. We ask you to be cautious and be seated when not being photographed
20. CAKE SMASH SESSIONS: Please advise us when booking if your child has any food allergies as we provide the cake, you must let us know prior or in your questionnaire when you fill it out

IMAGES, PACKAGES AND DELIVERY
1. No images and/or products ordered will be delivered unless full payment is paid in full.
2. Photography by Rachall has designed the packages in two parts. When booking a deposit specified is to be paid or not confirmation of a session with the studio can be booked. Then the remaining balance based on the package chosen on your session day needs to be made at the time of you're session or by the end of that day if choosing to bank transfer.
3. Images will only be kept in the archive after delivery for only 3 weeks, then destroyed
4. All packages are subject to change, but packages at the time of your booking will still be valid
5. All images are professional retouched and no additional editing, alteration to any images created by the photographer is allowed to be done without the photographer's permission. This includes copies or conversions to black & white or other tones
6. The client should be aware that the end print, production of the printed images of any product kind is not the responsibility or liability by the photographer in regards to quality, colours etc. 
7. Photographer uses a professional print lab for the studio and can guarantee results but cannot when client prints/produces products of their images outside of the studio using third party print labs (such as BigW or Kmart)
8. Images are edited to the like, style and work of the photographer
9. Any additional edits are not permitted if it relates to style, composition or colour. Any missed obvious edits are fixed if needed once only, additional incur a $10 per image fee
10. If the client chooses to print at other labs photographer is not liable for any discolouration, quality. This is why we advise printing through the studio
11. Reorder of a USB due to being lost or misplaced will incur an additional $50 fee payable to the photographer
12. Additional edits that are not in control of the photographer such as nail polish, flyaway hair, additional body shaping is not the photographer's responsibility and will incur an additional fee for extra editing after the first edit.
13. Once products are ordered no refunds or exchanges are possible
14. Albums are designed by the photographer only and ordered, no proof will be provided as all album designs are the same. If you require a personalized layout a $100 fee will be payable by you the client. We can send you one proof before we order your album or product and one edit changes only can be made. Please NOTE, we will not allow any images not taken by the photographer to be added to the album
15. Additional images or all the gallery can be purchased and you will be quoted on the day
16. Any USBS and/or products needed to be posted to you will incur a quoted postage fee quoted by the studio. USB'S and/or product are available for pick up

COPYRIGHT TERMS & CONDITIONS
1. It is illegal to redistribute these photographs for profit or use other than private consumption without ‘Photography by Rachall’s‘ permission. Violators of this federal law face severe criminal and civil penalties
2. Once images are selected on the day no changes can be made. No swaps of any images. Additional Images can be added for you to view within 2 days online after that gallery will be taken down online.
3. All images are given in JPG Format. No images are given un-retouched/edited under any circumstances
4. Photography by Rachall does not give RAW unedited images, therefore images cannot be altered, the colour changed or modified in any way that changes it from the original images.
5. The Copyright Act protects photographers by giving us the exclusive right to reproduce
your photographs. Violations include, but are not limited to, making illegal
copies, scanning, printing from home or downloading from our website. It is illegal
to copy or reproduce these photographs in any manner without our permission
and violators of this Federal Law will be subject to its civil and criminal penalties

Please understand, the photographer wishes to maintain complete control over
the print quality, finishes and presentation of the images and any reproduction outside
of the studio may lower the quality of the image and scar our reputation for providing
superior portraits.
